If you’ve been following the filesharing news, then you can’t have failed to notice the furore caused by the recent decision in a long-running case filed by RIAA against LimeWire. The case was filed in 2006, and has recently received this decision by US Judge Kimba Wood. The RIAA (representing the Big Four recording companies in the US) seems to have found a sympathetic ear in Judge Wood, who has gone where no other judge has dared to go. This decision may indicate the opening of the floodgates for similar cases against other filesharing networks. More likely it just represents Wood’s own views which will not be replicated further. When one considers the implications of the precedence set by this decision, it is easy to see why judges have been reluctant to rule this way in the past. Even if LimeWire are to be the example – the sacrificial lamb – that the RIAA so clearly craves, it is unlikely to be able to use the same tactics with other networks. Other networks – take Ares as a good example – are not so well defined as LimeWire. They are open source for a start, so there are no founders, owners or shareholders to work on. The RIAA have a long way to go.
